Welcome to elitediamonddawgs.com (the "Site"), owned and operated by Elite Baseball Academy, LLC ("Elite Baseball Academy," "we," "our," or "us"). By accessing or using this Site, or by participating in any programs, lessons, camps, or other services offered by Elite Baseball Academy, you agree to comply with and be bound by the following Terms and Conditions (the "Terms"). If you do not agree to these Terms, please do not use this Site or our services.

1. Use of the Site

The Site provides information about Elite Baseball Academy programs, home bases, teams, coaching staff, and services. It also enables visitors to submit inquiries, register for programs, and contact our staff. Your use of this Site is subject to our Privacy Policy, which governs our data collection and processing practices.

2. Electronic Communications

By using our Site, submitting forms, or sending emails to us, you consent to receive electronic communications from us. These electronic communications may satisfy any legal requirements that communications be in writing.

3. Program Participation & Assumption of Risk

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Baseball and softball training, including but not limited to batting practice, pitching, fielding, throwing programs, and competitive play, involve inherent risks of physical injury. By participating in any program, lesson, camp, tryout, or other activity offered by Elite Baseball Academy, you (or the parent/legal guardian of a minor participant) acknowledge and voluntarily assume all risks of injury, including but not limited to:

• Impact injuries from baseballs, softballs, bats, or other equipment
• Muscle strains, sprains, fractures, and other musculoskeletal injuries
• Arm, shoulder, and elbow injuries associated with throwing and pitching
• Heat-related illness during outdoor or indoor training
• Contact injuries during group activities or competitive play

You further acknowledge that:

• You (or the minor participant) are physically capable of participating in the chosen activity.
• You will follow all facility rules, safety guidelines, and staff instructions at all times.
• You are responsible for disclosing any pre-existing medical conditions, injuries, or limitations to coaching staff before participation.
• Elite Baseball Academy coaching staff may modify or limit a player's participation if they determine it is in the player's best interest for health or safety reasons.

This online acknowledgment supplements but does not replace any liability waiver or registration form you may be required to sign before participating in programs at our facility.

4. Minors & Parental Consent

Many of our programs serve athletes under 18 years of age. A parent or legal guardian must provide consent for any minor's participation in Elite Baseball Academy programs, camps, and team activities. Parents and guardians are responsible for ensuring that registration forms, waivers, and medical disclosures are completed accurately.

Our Site is not intended for use by children under 13 without parental supervision. See our Privacy Policy for details on children's privacy.

5. Fees, Payments & Refunds

• Program fees, lesson packages, cage rental rates, team fees, and camp fees are communicated at the time of registration or booking.
• Payment terms and methods are established at time of enrollment. Contact us for current pricing and availability.
• Refund policies vary by program type. Please inquire about the specific refund and cancellation policy applicable to your registration at the time of enrollment.
• Team registration fees may include tournament entry fees, uniforms, and other costs as specified during the registration process.

6. Facility Rules & Conduct

All posted rules and staff instructions at Elite Baseball Academy facilities are incorporated into these Terms by reference. By entering our facility and participating in activities, you agree to:

• Follow all safety rules and verbal instructions from coaching staff.
• Wear appropriate athletic attire and equipment as required by the program.
• Demonstrate good sportsmanship and respect toward coaches, staff, fellow athletes, and visitors.
• Refrain from any disruptive, dangerous, or unsportsmanlike behavior.

Elite Baseball Academy reserves the right to remove any individual from the facility or program for violating these rules, at our sole discretion, with or without refund.

7. Photo & Video Release

By entering an Elite Baseball Academy facility or participating in our programs, you (or the parent/guardian of a minor participant) consent to being photographed, filmed, or recorded. You grant Elite Baseball Academy, LLC a perpetual, royalty-free license to use images and likenesses in photographs, videos, and other media for marketing, promotional, social media, and advertising purposes. If you do not wish to be photographed or recorded, please notify our staff before participation.

8. Third-Party Links & Services

The Site may contain links to third-party websites and services, including Google Forms for program registration and Google Analytics for traffic measurement. Elite Baseball Academy is not responsible for the content, policies, or practices of third-party sites. Accessing linked sites is at your own risk, and you should review the privacy policies and terms of service of any third-party site you visit.

9. Intellectual Property

All Site content, including text, graphics, logos, images, and software, is owned by or licensed to Elite Baseball Academy, LLC and is protected by copyright, trademark, and other intellectual property laws. "Elite Diamond Dawgs" and associated logos and branding are the property of Elite Baseball Academy, LLC. Users may not modify, reproduce, distribute, or commercially exploit any Site content without prior written permission.

10. Prohibited Uses

Users may not:

• Use the Site for any unlawful or unauthorized purpose.
• Attempt to gain unauthorized access to Site data or systems.
• Disrupt or interfere with the Site's functionality or security.
• Scrape, harvest, or collect data from the Site without written consent.

11. Disclaimer of Warranties & Limitation of Liability

• Elite Baseball Academy, LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Elite Baseball Academy is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or participation in our programs.
• In no event shall the total liability of Elite Baseball Academy, LLC exceed the total amount you paid to Elite Baseball Academy in the twelve (12) months preceding the claim, or one hundred dollars ($100.00), whichever is greater.
• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Elite Baseball Academy, LLC and its officers, directors, employees, agents, coaches, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your participation in any programs or activities, or your violation of these Terms.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, USA, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Greenville County, South Carolina, and you consent to the personal jurisdiction of such courts.

14. Force Majeure

Neither Elite Baseball Academy nor you shall be liable for any failure or delay in performance due to events beyond reasonable control, including natural disasters, severe weather, pandemics, acts of government, utility failures, or civil unrest. In the event of force majeure, affected obligations shall be suspended for the duration of the event.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Elite Baseball Academy with respect to the Site and supersede all prior or contemporaneous agreements. These Terms do not alter or replace any separate liability waiver, registration form, or team agreement you may sign at our facility.

17. Changes to Terms

We reserve the right to update these Terms at any time. The most current version will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
